Auction provides a transparent, time-bound sales process in which buyers can see competing bids. The property is sold to the highest bidder once the reserve is met and the auctioneer completes the sale. Auction purchases are normally unconditional, so preparation before bidding is essential.

Before auction day

• Inspect the property and review all available documentation.
• Ask your lawyer or conveyancer to review the auction agreement and title.
• Arrange any building inspection, LIM review or other due diligence you require.
• Confirm your finance and the deposit required if you are the successful bidder.
• Register to bid and ask the salesperson how the auction will be conducted.

If you cannot attend in person, ask whether phone or online bidding is available for the particular property. Requirements can differ between auctions, so speak with the listing salesperson early.

Can a property sell before the auction?

That depends on the auction terms and the seller’s instructions. The listing salesperson can explain whether pre-auction offers will be considered.

What happens if the reserve is not reached?

If bidding does not reach the reserve, the auctioneer may pause while the seller considers what to do next. If the property is passed in, it has not sold. The seller decides whether to negotiate, with whom and on what terms; the highest bidder does not automatically have priority after the auction. Auction conditions can affect how later offers are handled, so ask about the terms for that property and get independent legal advice.
